I appreciate his pragmatic views when
it comes to interpreting the Constitution.
I had the opportunity to read a speech
he gave in Boston where he summarized
his jurisprudence in the following fashion
using this phrase: prudence, pragmatism,
reasonableness and utility. You can see that
in his decisions about equality issues and
other 14th Amendment issues. And I respect
that a great deal.
I’m an employment defense lawyer and
sometimes it’s hard to reconcile some of
his extensive views of employment law. For
example in the recent Vance [v. Ball State
University] decision, he was among the
dissenters who favored a broader definition
of ‘supervisor’ under Title VII. But that’s
consistent with his views as a pragmatic
jurist and I understand that. He was also
among the first to call on Congress to
overrule the majority in the Vance case
to specify what Congress meant by the
definition of supervisor.
Where would we go? I’m going to defer
to Justice Breyer on that one … and would
be thrilled to join him at his favorite Italian

a working lunch.
[I would choose him] because he is the
chief and he serves a pivotal role. It’s always
nice to talk with people that have influence,
and I think [it] would be very intriguing to
listen to him talk about his experience and
his role on the court. What is the dynamic
among all the justices? I think that would be
interesting to know.
