Robert S. Kelner
For over 60 years, Kelner & Kelner has represented personal injury and
medical malpractice victims. The firm’s attorneys have obtained hundreds
of recoveries of $1 million or more. Nine of the firm’s attorneys, Robert
Kelner, Gail Kelner, Ronald Burke, Todd Strier, Gerard Ryan, Monica Merrill,
Brian Hurley, Emil Samuels and Joshua Kelner, have been honored by
inclusion on the 2017 New York Super Lawyers list.
Robert Kelner has obtained approximately 300 verdicts and settlements
of $1 million or more. He achieved a verdict of over $29 million, which with
interest totaled over $40 million, in a trucking accident case involving
wrongful death. He has also achieved verdicts of $36 million against the
Transit Authority and $23 million in a motor vehicle accident. He is co-author,
with Gail Kelner, of the Trial Practice column in the New York Law Journal. He
lectures frequently at bar associations and has been chairman of the New
York County Lawyers Civil Trial Practice program for over 10 years. The New
York Times wrote a Public Lives column about him and his representation of
victims. He has appeared on CNN, MSNBC, ABC, NBC, CBS, NPR and BBC.
He has been quoted in The New York Times, New York Post, New York Daily
News and Newsday. He is a graduate of Columbia Law School, where he
lectures frequently on the subject of tort law and trial practice. He has also
lectured at Princeton University and Touro College School of Health Sciences.
Gail Kelner handles construction accident litigation, catastrophic injury
cases and other complex litigation. She is co-author, with Robert Kelner, of
the Trial Practice column in the New York Law Journal. She obtained $16.5
million for a construction worker who fell from a sidewalk bridge; $9.7 million
for a worker who fell off a ladder (she won his case in the Court of Appeals);
$9 million for a worker injured in a forklift accident; $9 million in an auto
accident; and a $10.4 million verdict with Robert Kelner on a case involving
the collapse of a sidewalk bridge. She recently, with Robert Kelner, obtained
$9 million in a wrongful death case of a window cleaner who fell 13 stories.
Ronald Burke has lectured extensively in the field of personal injury and medical
malpractice litigation. He has recently obtained recoveries of $7.25 million and
$5.25 million, and a verdict in a medical malpractice case of $7.9 million.
Emil Samuels works in all types of personal injury matters. He recently
achieved a $12.5 million verdict against the New York City Transit
Authority and approximately $5 million in a wrongful death settlement
arising out of a high-rise fire. He has also obtained a $3.8 million
recovery in a construction worker’s case and $3.8 million for a woman
who was burned in a fire in a shelter.
Todd Strier has obtained dozens of recoveries of $1 million or more. He
works extensively on cases of municipal union workers who are seriously
injured. He and Robert Kelner recently obtained $9 million for the wrongful
death of a sanitation worker. This is believed to be the highest recovery in the
death of a sanitation worker or uniformed worker in New York state.
Joshua Kelner graduated from Harvard Law School, with honors, and was
an editor of the Harvard Civil Rights-Civil Liberties Law Review. Recently, he
achieved a $19.1 million verdict against the New York City Transit Authority for
a man dragged by a subway train, and a $3.8 million recovery in a civil rights
case for a death at Rikers Island. He also recently argued and won a major
case before the New York State Court of Appeals on the duties of a landowner
to maintain the sidewalk. This year, he achieved a $4.5 million settlement in
federal court for a truck driver injured due to an allegedly defective roadway.
Monica Merrill, whose career began as a nurse, is the head of
the medical malpractice department. She has obtained dozens of
recoveries in excess of $1 million.
Gerard Ryan primarily works in the medical malpractice department.
He recently won a major appellate court victory limiting the rights of
defendants to discovery of certain private medical information about
injured plaintiffs. He, Robert Kelner and Gail Kelner recently obtained
$7 million for a worker killed at an arboretum in Long Island. He has
obtained numerous recoveries in excess of $1 million.
Brian Hurley has obtained many multimillion-dollar recoveries, including
a recent case in which an ironworker fell to his death, and a multimillion-
dollar recovery for the victim of an elevator accident.
Kelner & Kelner’s attorneys have donated significant sums for law school
scholarships, and have spent many hours of time for pro bono causes.
