Kramer, Dillof, Livingston & Moore has an extraordinary record of success
representing victims of medical malpractice, negligence, wrongful death and
personal injury. The firm has won more than 100 verdicts of over $1 million
for clients, and has negotiated settlements on behalf of clients in excess of
$1 billion. This past year, when the first Medical Malpractice Hall of Fame
was published by ALM, the firm was recognized for winning five of the top
25 cases on the list, more than any other firm. Two out of the three highest
verdicts ever awarded in New York history were achieved by our firm.
In addition to our medical malpractice specialty, the firm’s attorneys
recently won one of the largest personal injury verdicts in New York state
history: $172 million for a 29-year-old handicapped woman who was
tragically injured after New York City EMTs responded to her home and then
failed to perform even basic emergency care. The firm also negotiated a $20
million settlement for two recent college graduates who suffered third-degree burns when the popular household decoration they purchased from
a well-known national retailer suddenly and unexpectedly burst into flames.
“Our clients have suffered irreparable tragedy,” says Thomas Moore,
a senior partner. “We restore to them a measure of hope, dignity and
Senior partner Judith Livingston has received honorary Doctor of Law
degrees from Hofstra University and Fordham University, where she was
also honored with the University’s Founder’s Award. In 2014, she gave
the commencement address at Hofstra and was awarded the University
Presidential Medal. She was the first woman and youngest person in the U.S.
admitted to the prestigious Inner Circle of Advocates, a group of the top 100
trial attorneys; was called a Legal Legend by Lawdragon; and was cited as one
of “The 50 most influential women lawyers in America” by New York magazine.
Moore has twice received The National Law Journal’s Lawyer of the
Year honor, and has gained a reputation as one of the nation’s most
successful trial attorneys. Lawyers Weekly has called him the “Best Med-
Mal Lawyer in America.” Moore is also a member of the Inner Circle of
KRAMER, DILLOF, LIVINGSTON & MOORE
Advocates and, in 2015, he received an honorary degree from Fordham
and delivered the law school’s commencement address.
Livingston, Moore and two of their partners—Matthew Gaier and
Carmine Rubino—are again honored on the Super Lawyers list.
Gaier devotes most of his practice to appellate work, ensuring verdicts
won at trial are sustained on appeal. His record includes several of the
largest medical malpractice and personal injury verdicts ever upheld in New
York state. In 2014, the Appellate Division Second Department sustained
a $6.2 million verdict won by Livingston for a 61-year-old man’s wrongful
death and conscious pain and suffering. Gaier is also intimately involved in
the firm’s complex litigation matters and has developed particular expertise
in products liability cases. Gaier is the author of the definitive, three-volume
text New York Medical Malpractice (revised edition), and is the New York Law
Journal’s contributing expert columnist on the subject.
Rubino is the firm’s managing partner and guides each case through
the entire legal process. He prepares every case for trial, ensuring witnesses,
experts, arguments, motions and supporting documents—through the final
closing documents—receive the attention to detail that winning big cases
requires. Rubino handles one of the largest caseloads in the firm and is
involved in most of the complex medical, wrongful death and infant cases. His
expertise in negotiating major settlements on behalf of clients is well known
and respected throughout the legal community. Rubino also directs the daily
operation of the firm and is responsible for the management of all personnel.
“Every person in this firm—attorneys, medical experts, investigators,
KRAMER, DILLOF, LIVINGSTON & MOORE
paralegals—is committed to obtaining justice and just compensation
for people whose lives have been damaged,” says Livingston.
